The rules and obligations that govern your use of the FanSynQ platform and services.

Acknowledgement

These Terms and Conditions (the "Terms") form a binding legal agreement between you ("You" or "User") and FanSynQ, a d/b/a of MLCS Holdings Inc., a Delaware corporation (the "Company," "We," "Us," or "Our"). These Terms govern your access to and use of the website FanSynQ.com, along with any related applications, mobile apps, or software (together, the "Service" or the "Website").

By creating an account, browsing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree with any part of these Terms, you must stop using the Service immediately.

You confirm that you are at least 18 years old, or the age of legal majority in your jurisdiction if higher, and that you have the legal capacity to enter into this agreement. The Service is strictly for adults, and the Company does not knowingly permit anyone under 18 to create an account or access the Service.

These Terms apply to every visitor, registered user, content creator, and any other person who accesses or uses the Service, including anyone who appears in Content posted on the Service.

Your continued use of the Service is also conditioned on your acceptance of our Privacy Policy, which explains how we collect, use, store, and protect your personal information and describes your privacy rights.

Definitions

For purposes of these Terms, the following words have the meanings below. Terms defined in the singular include the plural and vice versa.

Account
The unique profile You create to access and use the Service.
Affiliate
Any entity that controls, is controlled by, or is under common control with a party, where 'control' means ownership of 50% or more of the voting shares, equity interest, or other authority to direct management.
Appeal
A request submitted by a person depicted in Content, asking the Company to review and, if warranted, remove that Content because it was posted without their consent or in violation of applicable law.
Company
Refers to FanSynQ, a d/b/a of MLCS Holdings Inc., a Delaware corporation, and, where the context requires, its Affiliates.
Complaint
A report submitted by any person alleging that Content on the Service is illegal, was posted without consent, or otherwise violates these Terms or our content standards.
Content
Any text, image, video, audio, livestream, message, or other material that is posted, uploaded, linked to, or otherwise made available on or through the Service, whether by the Company or by a User.
Content Creator
A User who is verified to upload, sell, or otherwise distribute Content on the Service.
Country
The United States of America.
Device
Any computer, smartphone, tablet, or other equipment used to access the Service.
Feedback
Any comment, idea, or suggestion You send us about the features, performance, or operation of the Service.
Merchant
A third-party payment processor engaged by the Company to process subscription and purchase transactions on the Service.
Service
FanSynQ.com and all related applications, mobile apps, and software offered by the Company (also referred to as the 'Website').
Terms
These Terms and Conditions, which form the complete agreement between You and the Company regarding use of the Service.
Third-Party Social Media Service
Any outside service, feature, or content — including data, information, products, or services — that may be linked to, displayed on, or made available through the Service.
User
Any individual who accesses or uses the Service, including visitors, registered account holders, and Content Creators.

1. Use of the Site

1.1 Your Account

When you create an account, you must give us accurate, complete, and current information. If any of this changes, you must update it promptly. Giving us false information may result in suspension or termination of your account.

You are responsible for keeping your password secure and for all activity that happens under your account, whether or not you personally performed it. Tell us right away at support@fansynq.com if you believe your account has been compromised.

1.2 Permissions and Proper Use

You may not choose a username that belongs to someone else, infringes a trademark, or is offensive, vulgar, or misleading. You agree to use the Service only for lawful purposes and in a way that does not restrict or interfere with anyone else's use of the Service.

2. Use of Our Services

2.1 Allowed Use

You may browse, subscribe to, purchase, and interact with Content on the Service in the manner the Service is designed to allow, and you may communicate with other Users through the tools we provide.

2.2 Not Allowed

  • Using the Service for any unlawful purpose, or to facilitate the exploitation, trafficking, or abuse of any person.
  • Attempting to gain unauthorized access to another User's account, our systems, or non-public areas of the Service.
  • Uploading viruses, malware, or code designed to damage or disrupt the Service.
  • Scraping, copying, or redistributing Content without authorization.
  • Circumventing age verification, identity verification, or content moderation systems.

2.3 Security and Misuse

We use technical and administrative safeguards to protect the Service, our Users, and our Company. Any attempt to misuse, probe, or interfere with these safeguards is a serious violation of these Terms and may be reported to law enforcement.

2.4 Suspension and Banning

We may suspend or permanently ban any account that violates these Terms, poses a risk to other Users, or is used in connection with illegal activity. Where required by law, we will provide notice of the reason for the action.

2.5 Support

If you need help using the Service, contact us at support@fansynq.com. See Section 21 (Support) for our response commitments.

3. Subscriptions and Billing

3.1 Promotional Codes

Promotional or discount codes are subject to the specific terms disclosed when the code is offered and may be limited, restricted, or revoked at our discretion for suspected abuse.

3.2 Billing Frequency

Subscriptions renew automatically at the frequency you select (for example, monthly) unless cancelled before the renewal date. We will send an advance billing reminder before each renewal where required by law or payment processor rules.

3.3 Changing Your Subscription

You may upgrade your subscription at any time, with the new rate applying immediately or at the next billing cycle as disclosed at checkout. You may downgrade your subscription, which will take effect at the start of your next billing cycle.

3.4 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation stops future billing but does not automatically refund amounts already charged. Refund requests are reviewed on a case-by-case basis.

3.5 Billing Disputes

If you believe you were billed in error, submit your dispute with your account details and transaction information to support@fansynq.com. We will respond within seven (7) business days.

3.6 Changing Payment Methods

You can update your payment method at any time in your account settings. All payments are processed securely by our third-party Merchant; the Company does not store full payment card numbers.

4. Marketing and Communications

4.1 Allowed Use

We may send you service-related messages (such as billing notices and security alerts) and, where you have opted in, marketing messages about new features, promotions, or Content.

4.2 Opt-In and Opt-Out

You choose whether to receive marketing communications when you create your account, and you can opt out at any time by using the unsubscribe link in any marketing email, adjusting your notification settings, or emailing support@fansynq.com. Service-related messages necessary to operate your account cannot be opted out of while your account remains active.

4.3 Updating Your Information

You can update your contact information and communication preferences at any time in your account settings.

5. Content: Ownership, Use, and Restrictions

5.1 Ownership

You retain ownership of the Content you create and post. By posting Content, you grant the Company a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that Content solely to operate, promote, and improve the Service.

5.2 Your Promises to Us

When you post Content, you promise that: (a) you own the Content or have full legal permission to post it and grant us this license; (b) everyone shown in the Content is at least 18 years old and gave their informed, voluntary consent to being depicted and to that Content being distributed on the Service; and (c) the Content does not violate any law or any other person's rights.

5.3 Acceptable Use of Content

Content must comply with these Terms and with all applicable laws. We may review, format, label, or restrict the visibility of Content to keep the Service safe and lawful.

5.4 Licensing to Other Users

When you sell or share Content with another User under the Service's normal features (such as subscriptions or paid messages), that User receives a limited, non-transferable right to view the Content for personal use only. They may not copy, redistribute, or resell it.

5.5 Removal, Rejection, and Disputes

We may reject, remove, or restrict Content that violates these Terms, without prior notice where necessary to prevent harm. You may dispute a removal decision using the Appeals process described in Section 8, or by contacting support@fansynq.com.

6. Prohibited Content

To protect our Users, our community, and the public, the following Content is never allowed on the Service, regardless of context, labeling, or claimed consent. Posting prohibited Content will result in immediate removal, account termination, and may be reported to law enforcement or the National Center for Missing & Exploited Children (NCMEC) or equivalent authorities.

  • Child sexual abuse material or any sexualized depiction of a minor: Any Content that sexualizes, depicts, or implies sexual activity involving anyone under 18, or that is presented as depicting a minor, is strictly prohibited. This includes Content where a participant appears to be, is claimed to be, or is styled to look underage.
  • Non-consensual content: Depicting, describing, or implying sexual activity where consent was not given, including content that is presented as forced, or that depicts a person who is unable to consent (for example, because they are asleep, unconscious, or incapacitated).
  • Content shared without the consent of everyone depicted: Photos, videos, or recordings of a real, identifiable person posted without that person's knowledge or agreement (voyeurism), including hidden-camera or hypnosis-themed content.
  • Incest or family-role-play content: Content depicting or implying sexual activity between family members or presenting family relationships in a sexual context.
  • Bestiality: Content depicting or implying sexual contact between a human and an animal.
  • Extreme violence, gore, or bodily harm: Content depicting blood or injury resulting from violence, self-mutilation, crushing of live animals or insects, flogging, suffocation, or other severe physical harm, whether real or staged.
  • Death and autopsy imagery: Autopsy photos, depictions of death, or "snuff" or fantasy-snuff style content.
  • Kidnapping or abduction themes involving real depicted persons: Content that depicts a real, identifiable person in a non-consensual abduction or captivity scenario.
  • Exchange of sex for compensation depicted on the Service: Content that depicts or advertises prostitution or the direct exchange of money for sexual activity outside of the Service's lawful subscription and tipping features.
  • Bodily waste content: Depictions of urination, defecation, or vomiting in a sexual context involving another person.
  • Drug-facilitated or chloroform-themed content:Content depicting or implying the use of drugs, alcohol, or chemical agents to incapacitate a person for sexual purposes.
  • Hate speech and discriminatory content: Content that promotes hatred, violence, or discrimination based on race, ethnicity, religion, national origin, sexual orientation, gender identity, disability, or other protected characteristics, including content that is sacrilegious or demeaning toward a religious group.
  • Cannibalism themes: Content depicting or implying the consumption of human flesh.
  • Polygamy solicitation or dating content:Content soliciting or promoting polygamous relationships or marriage arrangements through the Service.
  • Credit card or financial information collection outside authorized checkout: Requesting or collecting another User's payment card or financial account details outside of our Merchant's secure checkout process.

This list is illustrative, not exhaustive. The Company may remove any Content, at its sole discretion, that it reasonably believes is illegal, unsafe, or harmful, even if not specifically listed above.

7. Complaints Policy

Anyone — whether a User of the Service or not — may report Content they believe is illegal, was posted without consent, or otherwise violates these Terms.

7.1 How to File a Complaint

Send a complaint to support@fansynq.com or use the "Report" tool available next to Content on the Service. Please include: (a) a link or clear description of the Content; (b) the reason you believe it violates our Terms or the law; and (c) your contact information, so we can follow up if needed.

7.2 Review Timeline

Every complaint is reviewed by our Trust & Safety team. We will complete our initial review and take appropriate action within seven (7) business days of receiving a complete complaint. If a complaint requires more time due to its complexity, we will notify the complainant of the delay and the expected timeline.

7.3 Review Steps

  1. Intake: The complaint is logged and assigned to a reviewer.
  2. Investigation: The reviewer examines the reported Content, relevant account records, and any consent or age-verification documentation on file.
  3. Decision: The reviewer determines whether the Content violates these Terms or applicable law.
  4. Action: If a violation is found, the Content is removed, restricted, or the account is subject to further action under Section 2.4.
  5. Notification: The complainant and, where applicable, the Content Creator are notified of the outcome.

7.4 Appeal of a Complaint Decision

Either party may appeal the decision as described in Section 8 (Appeals Policy).

7.5 Possible Outcomes

  • No violation found — the Content remains on the Service.
  • Content removed or restricted, with no further action against the account.
  • Formal warning issued to the account holder.
  • Temporary suspension of the account.
  • Permanent termination of the account.
  • Referral to law enforcement or a relevant regulator, where the Content may involve criminal conduct.

8. Appeals Policy

Any person depicted in Content on the Service — regardless of whether they are a registered User — has the right to appeal and request that the Content be removed.

8.1 Filing an Appeal

Send your appeal to support@fansynq.com with a description of the Content, why you believe it should be removed, and any supporting information, such as proof of identity or evidence relating to consent.

8.2 Investigation and Removal

We will investigate the appeal following the review steps in Section 7.3. If our investigation determines that consent was not given, was withdrawn, or is void or unenforceable under applicable law, the Content will be removed and will not be permitted back on the Service.

8.3 Resolving Disagreements Through a Neutral Body

If the Content Creator or Merchant disagrees with the outcome of an appeal, and the disagreement cannot be resolved between the parties, either party may request that the dispute be referred to a neutral third-party reviewer or arbitrator under Section 9 (Arbitration) to reach a binding resolution. This ensures that any conflicting statements about consent are resolved by an independent party rather than left unresolved.

9. Arbitration

We hope most concerns can be resolved informally. If a dispute between you and the Company cannot be resolved informally within thirty (30) days, either party may require the dispute to be resolved by binding arbitration instead of in court, except where prohibited by law.

9.1 How to Request Arbitration

To start arbitration, send a written "Notice of Arbitration" to support@fansynq.com describing the dispute, the relief you are seeking, and your contact information. The Company will respond within thirty (30) days.

9.2 Arbitration Process

  • The arbitration will be conducted by a single, neutral arbitrator through a recognized arbitration provider, using its rules for consumer disputes.
  • The arbitration will take place in the state of Delaware, or another location or format (including by video or written submission) mutually agreed by the parties.
  • Each party is responsible for its own attorneys' fees, unless the arbitrator determines otherwise or applicable law requires a different allocation.
  • The arbitrator's decision will be final and binding, subject to any limited right of court review provided by law.

9.3 Exceptions

Either party may bring an individual claim in small claims court instead of arbitration, if the claim qualifies. Nothing in this section limits a person's right to file a complaint with a government agency or to seek emergency relief from a court to prevent imminent harm.

11. Child Protection

The Company has a zero-tolerance policy toward any content or conduct that endangers children. We protect children by:

  • Requiring verified, government-issued proof of age for every Content Creator before they may publish Content.
  • Using automated and human review to detect and remove any Content that sexualizes or endangers minors, as described in Section 6.
  • Immediately terminating any account associated with such Content and reporting it to the National Center for Missing & Exploited Children (NCMEC) and law enforcement, as required by law.
  • Preserving evidence as required by law to support investigations.

Anyone who becomes aware of content that may endanger a child should report it immediately to support@fansynq.com and, where appropriate, to local law enforcement or the CyberTipline at CyberTipline.org.

12. Community Health

We want the Service to be a place where Users and Content Creators can participate safely. We support community health by:

  • Providing tools to block, mute, or report other Users.
  • Enforcing these Terms consistently against harassment, hate speech, and abusive behavior.
  • Offering resources and information about mental health and wellbeing support for Users who may need it.
  • Regularly reviewing our policies and moderation practices to keep pace with emerging risks.

13. Adult Content Creator and Worker Protection

The Company recognizes the rights and wellbeing of the adult performers and Content Creators who use the Service. We support them by:

  • Verifying that every Content Creator is at least 18 years old and has voluntarily agreed to appear in and monetize their Content.
  • Prohibiting any Content that depicts coercion, trafficking, or non-consensual activity, and removing it immediately when identified.
  • Giving Content Creators control over pricing, availability, and removal of their own Content, and honoring valid takedown or appeal requests.
  • Providing a confidential channel, support@fansynq.com, for Content Creators to report coercion, exploitation, or unsafe conditions without fear of retaliation.
  • Cooperating with anti-trafficking and labor organizations and referring Content Creators to appropriate support resources when needed.

14. Abuse Reporting and Response Policy

If you experience or witness abuse, exploitation, harassment, or unsafe conduct connected to the Service, please report it right away.

14.1 How to Report

Email support@fansynq.com with details of what happened, when, and who was involved, or use the in-Service reporting tool. Reports can be submitted anonymously, though providing contact information helps us follow up.

14.2 Our Response

  • We acknowledge reports promptly and begin review under the process described in Section 7.3.
  • We take immediate protective action where there is a risk of ongoing harm, including suspending accounts pending investigation.
  • We refer matters involving potential criminal conduct, trafficking, or harm to a minor to law enforcement and relevant authorities.
  • We do not tolerate retaliation against anyone who reports abuse in good faith.

16. Intellectual Property

Apart from Content posted by Users, the Service and all of its original features, design, and functionality are and remain the exclusive property of the Company and its licensors, and are protected by copyright, trademark, and other applicable laws. You may not use the Company's trademarks or trade dress without our prior written consent.

16.1 Your Feedback

If you send us Feedback, you agree that we may use it freely to improve the Service, without any obligation to compensate you.

17. Termination

We may suspend or terminate your account at any time, with or without notice, if you violate these Terms, pose a risk to the Service or its Users, or as required by law. You may terminate your account at any time by discontinuing use of the Service or by contacting support@fansynq.com. Sections of these Terms that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and dispute resolution — will continue to apply.

18. Disclaimers and Limitation of Liability

18.1 Limited Warranty

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

18.2 No Guarantees

We do not guarantee that the Service will be uninterrupted, error-free, or completely secure, or that all Content will be accurate or appropriate for you.

18.3 Limitation of Liability

To the maximum extent permitted by law, the Company's total liability for any claim relating to the Service is limited to the amount you paid through the Service in the twelve (12) months before the claim, or 100 USD if you have not made a purchase. The Company is not liable for indirect, incidental, or consequential damages. Some states do not allow these limitations, so they may not fully apply to you.

18.4 Right to Change These Terms

We may update these Terms from time to time. If a change is material, we will provide at least thirty (30) days' advance notice before the new Terms take effect, such as by email or a notice on the Service. Continuing to use the Service after changes take effect means you accept the updated Terms.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware and applicable United States federal law, without regard to conflict-of-law principles, except to the extent the Arbitration provisions in Section 9 apply. If you are a European Union consumer, you also benefit from any mandatory consumer-protection provisions of the law of the country in which you reside.

You confirm that you are not located in a country subject to a U.S. government embargo and that you are not listed on any U.S. government list of prohibited or restricted parties.

20. General Provisions

20.1 Severability

If any part of these Terms is found unenforceable, that part will be interpreted to fulfil its intended purpose as closely as possible, and the rest of the Terms will remain in full effect.

20.2 Waiver

If we do not enforce a right or provision right away, that does not mean we give up the right to enforce it later.

20.3 Entire Agreement

These Terms, together with our Privacy Policy, form the entire agreement between you and the Company regarding the Service.

21.2 Response Policy

We aim to acknowledge support requests within two (2) business days and to resolve most issues within seven (7) business days. Complaints and appeals follow the specific timelines described in Sections 7 and 8.

21.3 Performance

We regularly review support and moderation performance to make sure we are meeting these commitments, and we welcome feedback on how we can improve.
